SB204 - Disabled Parking Permits and the DMV PASSES HOUSE in Final Hours!

ANCHORAGE, AK - June 07, 2018 - It ended up being a real nail-biter folks but SB204, the bill introduced by the Alaska Chiropractic and sponsored by Senator Dennis Egan to add chiropractors to the list of authorized healthcare professionals able to complete applications for Disabled Parking Permits with the DMV passed the State House on 05/10/2018 with a vote of 37 YEAS and 1 NAY.  Two amendments were introduced on the House floor - one that failed and one that was adopted.  Here's the final version of the bill that was passed SB204Z.  *Section 3 is our original bill.  All other sections are amendments added in the House Rules Committee or from the House Floor.  Here's the original/final language *Section 3 - AS 28.10.181(d) is amended to read:  For purposes of this subsection, proof of disability may be provided by a person licensed as a chiropractor under AS 08.20, as a physician or physician assistant under AS 08.64, or as an advanced practice registered nurse under AS 08.68. <--the bolded and underlined section is the addition made to the statute.  Representative Chris Tuck was the House sponsor for the original version of SB204. 

 The revised bill was sent to the State Senate for concurrence on the amendments on 5/11/18.  The State Senate voted 19 YEAS/0 NAYS to concur on the House amendments on 05/12/2018.  

So what now?  The bill will be tranferred to the Office of the Governor for signature.  Once SB204 is signed by Governor Walker, the statute change will allow the DMV to revise their form(s) and once again begin accepting disabled parking permits from chiropractors.  The Alaska Chiropractic Society will be sure to notify DCs across the state when the bill is signed and the effective date of the statute.  

History regarding the what and why this legislation was introduced - Prior to 2016, chiropractors had been completing the DMV disabled parking applications for over 30 years but an AG's opinion in 2016 found that chiropractic physicians did not meet the parameters of the narrowly written statute AS 28.10.181 (d) limiting the group to a "physician or physician assistant under AS 08.64 or as an advanced practice registered nurse under AS 08.68."  The DMV revised Form 861 in 11/2016 and removed chiropractors.  Patients with applications completed by chiropractors were told the application would not be accepted approved and that they had to seek completion from one of the providers listed.  

I would like to take this opportunity to thank all the DCs who answered the call to assist in getting this bill through the legislative process - you all were my lifeline and did not hesitate to act when called!  I'd like to thank Dr. Ed Barrington, Dr. Todd Curzie, Dr. Bill West, Dr. Karen Zamzow, Dr. Jeffrey Reinhardt, Dr. Joseph Hawkins, Dr. August Manelick, Dr. Warren Moore, Dr. Michaela Krohn, Dr. Brian Larson, Dr. Anthony Endsley, Dr. Matt Pyhala and Dr. Evan Frisk.  We all owe a HUGE debt of gratitude to Dr. Daniel Holt for taking time away from his practice to testify in person at the many committee hearings.  Dr. Holt - you are my HERO!  A round of applause to you all - you were very integral in making this happen!  I am also eternally grateful to our lobbyist Jeff Logan for his sound advice in navigating the political process and his calm demeanor in the face of my frustration and angst.
