AK Health Care Services Price Transparency Regulations - 7 AAC 86.010 - Although public comment period ended 9/27/2019 for the proposed regulations, the regulations are STILL NOT FINALIZED YET.

The regulations and public comment are currently being reviewed by the Department of Law.

What is the AK Health Care Services Price Transparency Law? This is the law that went into effect 1/1/2019 requiring all health care providers and facilities to post their undiscounted fees charged or the top 10 codes in each of the 6 sections of the CPT book in their office waiting room, on their website and submit to DHSS. It also had a provision for providing good faith cost estimates for care orally, in writing, or by electronic means. Your office does need to comply with providing good faith cost estimates when requested.

But, DHSS will NOT impose a penalty on any health care provider or health care facility for failure to comply with AS 18.23.400(a) – (f), requiring price collection, posting, and reporting to DHSS, beginning January 1, 2019 AND CONTINUING UNTIL IMPLEMENTING REGULATIONS ARE IN EFFECT.

UPDATE 02/18/2020 - The Health Care Services Price Transparency (7 AAC 86) proposed regulations are still in the State of Alaska’s (SOA) regular regulations process. The SOA Department of Health and Social Services (DHSS) will review the public comments and proposed draft regulations. If the proposed draft regulations are adopted by the DHSS Commissioner, we will prepare and send a final law review packet to the SOA Department of Law for its final review. After the Department of Law completes its review, and DHSS approves the final version, the Department of Law will deliver the packet to the SOA Lieutenant Governor’s Office to be filed. The regulation will be effective 30 days after it is filed by the Lieutenant Governor’s Office. As the regulation is not final, the DHSS notice on not imposing a penalty for failure to comply with AS 18.23.400(a) – (f) still stands. Please see the notice here:
